It is an issue. and becomes bigger - this is what was written to me: face book reserves all rights to all and any photos posted it becomes a social media situation ... will not win. My response was and is: no you took and used for advertising and promotional purposes. facebook has certain rights that does not mean you do or that you or anyone else can just take what you please and use it for what you please. and if you look at the terms facebook holds no right to others copyrights, i.e. photographs. Either this resolves happily now or the Courts can deal with it and send a message and tell the world: No One has the right to take a photograph or the likeness of someone and USE IT For Advertising or Promotional Usage without their permission, in writing. Actually to use it in New York is illegal. and on the books as a criminal offense, as well as Civil liabilities. FYI. NYS Civil Rights code 50 and 51. Ecru is not going to be happy about this.
