‘Court Remains Only Option For Al-Makura, Assembly’ Donatus Nadi — Aug 12, 2014 | Leave a comment A legal practitioner, Barr. Bashir Jabiru, has said that the court of law remains the only alternative for Governor Umaru Tanko Al-Makura and the Nasarawa State House of Assembly (NSHA) in their bid to address issues arising from the botched attempt by the lawmakers to impeach the governor. Barr. Jabiru, who made this submission in Lafia in a chat with LEADERSHIP yesterday, said the Assembly has resolved to challenge the legality of the composition of the probe panel set up by Justice Suleiman Dikko as contravening section 188 (5) on the constitution. “The first option left for the Assembly is to await the submission of the detailed report of the panel. However, whatever misgivings the Assembly has as expressed by their counsel has to be addressed by the court after the committee must have submitted its report and not earlier,” he said. The former state chairman of Action Congress of Nigeria (ACN) noted further that Al-Makura’s legal team is also going to court to challenge the non-compliance of the Assembly to section 188 (2) of the constitution which stipulates conditions for service of impeachment notice and section 188 (7) which deals with the Assembly’s dereliction of duty by not providing the constituted panel with guidelines of proceedings. Commenting on other alternatives before the executive and the legislature, he said “As a leader who cherishes peace, the governor should extend an olive branch to the members of the Assembly because both parties cannot afford to set the state on fire on the basis of partisanship”. Speaking in the same vein, the chairman of Lafia local government, Hon Suleiman Wambai, wondered why the Assembly which consisted of over 70 per cent of the current lawmakers did not consider impeaching Governor Aliyu Akwe Doma who “collected more than N90billion in Paris Club loan and over 180billion in federal allocation between 2007 and 2011 with nothing to show for it”. He said, “By the failure of the impeachment, I can authoritatively tell you that the PDP has lost 2015 general election and the electorate would not allow a repeat of this impasse by ensuring that APC is voted massively into the legislature”. “The PDP’s attempt to come through the backdoor has failed; so also, they will receive their annihilating defeat come 2015 because the electorate in Nasarawa State cannot be manipulated as the PDP thought”.
