A neighbor says she called officials last week complaining of the dogs condition. She claims this isnt the only case shes concerned with in her neighborhood. The past couple of weeks, when Ashley Baker called for Boe to give him a treat, hed hobble from his dog house to the fence to greet Baker. Thursday, she called for him, he didnt respond. Oh no! Baker exclaimed. Oh my God. I think hes dead. Hes right here. Baker found him on the ground next to his dog house. Baker says Boe, who lived at a home across from her, was alive Wednesday. She took a picture of him inside his dog house, but says he was too weak to get out. Additional images show the dog, Baker says in emaciated conditions with infections and large lumps near his throat. Owner Carroll Dyke says he could tell Boe was suffering Wednesday night, but didnt know his dog had died until we showed up. Dyke: Early in the morning I could hear him moaning. I didnt come out here because I suspected that. Reporter: So you heard him moaning, thought he was dying but didnt come outside? Dyke: At 4:00 in the morning? Reporter: But hes your pet. Dyke: But listen, pets to you are evidentially different than it is to me. NBC 12 notified animal control officers who came out immediately to speak with the owner and begin the investigation. Officers are also looking into the dog owners next door to Baker. She says a female Pit bull used to live in a cage with another dog until last week. The owner was kicking the female pit, then I watched him reach over and burn her with the cigarette in his hand and told him to stop because she was yelping, Baker added. She was convulsing really bad. He threw her in the back of the car and sped off. NBC12 tried speaking to the man who lives inside, but he did not comment. Chesterfield Animal Control officials say theyll be investigating each case separately. Animal Control says it will also consult with the Commonwealth Attorneys Office on this case. Carroll Dyke admitted, in front of our camera back in October, that he knew his dog was suffering, but didnt do anything about it. His neighbor, Ashley Baker, called us because she was concerned about the welfare of her neighbors dog. She would feed Bo on a regular basis, so she knew when something was wrong. Baker took pictures of Bo while he was inside his dog house. She says he was too weak to get up. The pictures show that Bo was emaciated. Baker said he had infections and large lumps near his throat. Dyke said he knew the dog was suffering, but didnt know he had died until Baker and our crew showed up. Back in October, a neighbor found Dykes dog deadshortly after contacting NBC12 about his condition. Bo - the pit bull mix - suffered tremendously before his death. A letter from the vets office that performed the dogs necropsy states that Bo died an extremely inhumane death that could have been prevented with the proper medical care. Its a good day, said neighbor Ashley Baker. He was found guilty. Justice for Bo! In the necropsy report, a number of problems caused the dog to die. Some include: fluid in his chest, parasites, infections, and a failed liver. Bos decline was obvious to Baker, and our cameras were rolling the day she called us for help - only to find Bo deceased in Dykes backyard. Dyke admitted his dog had stopped eating weeks before he died. Dyke stated he didnt have the money to take care of Bo - and never contacted Animal Control or a vet for help. He thought his 12-year-old dog was just getting old, but the prosecution didnt buy that- saying indifference is at the heart of the crime. I would encourage people if you see anything like this happening, dont be afraid, Baker urged. Go call Animal Control, call police. Get some kind of record - pictures, video. Im very thankful for Channel 12 for coming and responding and helping me NBC12 also tried speaking to Mr. Dyke outside the courthouse, but he declined to comment. Dyke has 10 days to appeal. If he doesnt, he will start his community service. Dyke will not face any jail time for the offense, as long as he stays on the right side of the law. He was sentenced to pay a $100 fine, serve 100 hours of community service and to never own a pet again. He was also sentenced to 12 months in jail, but the entire sentence was suspended.
