DfE have decided to uphold my appeal for the minutes that Tim Boyes claimed he warned of extremists in schools in 2010. I asked for a redacted version to clarify his claims which would protect the enmity of officers (excuse that was given before).... still denied on this appeal. Next, appeal to the ICO Dear Mr Ashraf, I refer to your complaint received on 8 September and two received on 9 September. Please note that the three emails have been treated as one request for an internal review. The six specific questions set out at the end of your email of 9 September have been treated as a breakdown of your original request and we have not taken this to be a separate request. Your original request (2014/0055640) asked for minutes to the meeting held with Tim Boyes in December 2010. The Department has now completed its internal review process and has carried out a thorough review of the case, chaired by a senior officer who was not involved with the original request. The Department has decided to uphold the original decision not to disclose the information concerned, for the reasons set out in the letter of 8 September 2014. In addition to the application ofexemptions 36 (2)(b)(i), 36 (2)(b)(ii) and 36(2)(c) the panel agreed that section 40(2) of the Act should also apply. Some information is exempt under Section 40(2) of the Act on the grounds that release of the information would breach one or more of the principles of the Data Protection Act 1998. This exemption is absolute in these circumstances, which means the Department is not required to examine the public interest test. I understand that you have concerns as a parent of a child at one of the schools involved in the Trojan Horse allegations and why you feel it is in the public interest to know that any concerns raised have been dealt with effectively. This has been taken into consideration. As set out in the letter, the information is part of the Review being conducted by the Permanent Secretary which will look into whether any warning signs were missed. It is important that this information is not prematurely released so that it can be considered effectively and without prejudicing the outcome of the review, and hence the conduct of public affairs. If you are unhappy with this decision, you have the right to appeal directly to the Information Commissioner.
