ANYIMADU Dear Sir, PETITION FOR THE IMPEACHMENT OF PRESIDENT JOHN DRAMANI MAHAMA The Progressive Nationalist Forum (PNF) is hereby petitioning the Parliament of the Republic of Ghana to, as a matter of urgency, commence impeachment proceedings to remove President John Dramani Mahama from office over his mismanagement of the economy which is plagued with massive levels of corruption. His conduct is inimical to the economy and the security of the state. Article 69 of the 1992 constitution of the Republic of Ghana gives the mandate to parliament to remove a president from office whenever his conduct is prejudicial or inimical to the economy or the security of the state. Article 69 (1): The President shall be removed from office if he is found, in accordance with the provisions of this article - (b) To have conducted himself in a manner - (ii) Prejudicial or inimical to the economy or the security of the State; (2) For the purposes of the removal from office of the President, a notice in writing - (a) Signed by not less than one-third of all the members of Parliament, and (b) stating that the conduct or the physical or mental capacity of the President be investigated on any of the grounds specified in clause (1) of this article, shall be given to the Speaker who shall immediately inform the Chief Justice and deliver the notice to him copied to the President. Therefore, parliament has the constitutional mandate to commence the impeachment process and save Ghana from the abuse of our state resources through corruption. The Cases against the President 1. Armed Forces Aircrafts Acquisition Scandal: According to a former Attorney General, Mr. A.B.K Amidu, the late President Mills had reasons to set up a Committee of Enquiry to investigate the acquisition of aircrafts for the Ghana Armed Forces led by the then vice President John Mahama. This in effect was an investigation of corruption against a sitting Vice President, the first ever in the political history of Ghana. President Mahama and the government have since not responded to the allegation. Hon. William Aboah, Mr. George Amoah and Brig. Gen. Allotey (Rtd.), members of the committee have also not responded either. We strongly believe that Mr Amidu will make himself available to this house if called upon with regards to this matter. 2. The Armajaro Scandal: As Vice President of the Republic of Ghana, President Mahama was caught up in the Armajaro Scandal where he negotiated for the pardon and reengagement of the British firm banned from operating in Ghana. The PNF has in its possession full documentary evidence indicating the President’s involvement in short- changing the Ghanaian cocoa farmer, which we are making available to the house of parliament along with this petition. We are readily available to take the witness box and also further call on other witnesses in this matter. 3. The lack of interest by the President and the government to retrieve the £ 42 million “Judgement” debt illegally paid to Austro Invest. The laxity with which obviously “dubious” government debts are handled by the Attorney Generals department culminating into the payments of huge judgement debts totalling some GHS 600 million to undeserving persons, while the president looks on, is unacceptable and an incentive for further corruption. 4. The President looks on whilst a private individual without much of state support, Mr. Martin Amidu continues to pursue through the courts for the retrieval of our monies illegally paid to some firms and individuals as in the case of the Supreme Court ordering two foreign companies to refund over GH ¢60 million to the state. 5. The GYEEDA Scandal: the lack of Presidential will in the implementation of the ministerial report on GYEEDA which concludes that from 2009 to 2012, almost nine hundred and fifty million Ghana cedis (GHS950, 000,000.00) had been expended on NYEP without benefit to ordinary Ghanaians. 6. The SADA Scandal: The Azontaba Guinea Fowl Production and Marketing Company had some GHC 15m on the guinea fowl Project and GHc32.298 million on afforestation in 2012 alone with nothing to show. 7. The SUBAH / GRA Scandal: unfolding GH¢ 144 million scandal, involving the Ghana Revenue Authority (GRA) and Subah Infosolutions Ghana Limited, has exposed curious payments by the latter to a tall list of individuals and companies. The Subah Infosolutions was contracted by the GRA in 2010 to provide telecom traffic monitoring services for the Tax Agency. Over the last two years, the company received up to GHC 144 million from the GRA, mostly in monthly instalments. 8. The over a US$100 million oil revenue loss between 2011 and 2013 as reported by the Public Interest & Accountability Committee headed by Major Daniel Ablorh – Quarcoon (rtd). 9. The Auditor General Report 2012; information also points to the Auditor General’s report 2012, also contains massive revelations of corruption. We pray parliament to, as a matter of urgency, cause the Auditor General to make available its report for 2012 with immediate effect. It is our sincerest belief that the events chronicled in this petition have the potential to cause and are causing economic and security risk to Ghana and therefore good grounds to evoke article 69 to legally remove the President from office. ……………………………………… …….. ……………………………………… ……..
