It is not mentioned in Mutawattir Ahadith that are needed for a Hadd/penal punishment. 3. The punishment is not equivalent to the crime. 4. Early scholars among the Hanafi were against it, as well as many among the Mutazilah and Khwariji, and several among the Shi‘a. The idea of consensus is a post-900 invention. 5. If there is doubt (Shubha) in sources, evidences or witnesses, then no punishment may be given. 6. Many contemporary scholars reject it (Abu Zahra, al-Khui).
