11 July Friday :A tour guide arrested after the death of a Russian tourist in Mombasa on Sunday was yesterday arraigned in court. Derick Ngome was charged with operating as a citizen tour guide without a licence. The prosecution said Ngome committed the offense of July 6 at Kibokoni village in Mombasa subcounty. Ngome was guiding three Russian tourists when one of them, Maria Tatyana, was shot after three gunmen confronted them.The deceased was shot after she allegedly refused to surrender her bag as ordered by the attackers. Report from the police said the four were walking on a narrow street in Fort Jesus area t the time of the attack. A pathologist at Pandya Memorial Hospital confirmed to the Star that Tatyana died from cardiopulmonary arrest, which resulted from a damaged tissue in the brain and excessive bleeding. The body awaits to be fled to Russia for burial. Charles Kinyanjui, Ngomes lawyer pleaded with the court to release his client on a favorable cash bail or a reasonable bond term referring the case as a criminal attack. “It was a criminal attack and my client could have been a victim during the attack, he was no way involved in the killing and he availed himself and reported the matter to the police soon after it happened. There is no report from the tourism police unit opposing the release of my client and this indicates that its beyold reasonable doubt that my client is not involved in this offense,” added Kinyanjui. Kinyanjui said his client has been working as a registered tour guide at Fort Jesus area for a long time, only that at the time of the incident his license had expired and awaiting renewal. He prayed the court to give a fair ruling to his client considering that he has been in custody since Sunday and that he has cooperated well with the police during the investigation to catch up with the involved criminals. Prosecutor Eugene Wangila had no opposition to the bond application, he however urged the court to consider that the case involved loss of life. The accused to the charges before chief magistrate Maxwell Gicheru. He was released on a Sh 50,000 surety bond. The hearing was set for August 28.
