18 year old client is asked to drive an older friend (moms boyfriend) to the store. On route the man pulls a gun and says to the 18 year old park here. You better be here when I get back or Ill hunt you down and kill you. This per the client. The man claims the 18 year old was in on it. The man then robs a party store at gun point. Comes back to the car and the 18 year old drives the car away. 18 year old gets $10 from the robbery. Man takes the rest, couple hundred. The 18 year old pleads not guilty by reason of duress. He thought the the man would kill him. The government argues that when he was out of the car the 18 year old should have drove off and went to the police if not involved. The 18 year old claims he was afraid to leave, didnt know where the robber was so couldnt leave. Under Michigan Law the driver of the getaway car as a co-conspirator would be guilty equally as the robber.if not duress. He was charged with 1 Count armed robbery a life offense and 1 count felony firearm a two year offense, consecutive to the armed robbery What is he guilty of if anything? What should the result be?.
