A Cape Breton 24 Year Old Murder Mystery and Cover Up Let’s Help to Ensure It Does Not Make It 25 17 year old Clayton Miller, unknown to the police attended an outdoor party. His battered body was found face down in a small brook May 1990. The next 24 years have been a nightmare. This case has gone unanswered for 24 years and is now with the Nova Scotia Medical Examiner for review. For 24 years The Millers have sought answers and the buck has been passed, the door has been slammed shut. Please help support the Millers bring Justice for Clayton. Answers to the following questions are a minimum of what any parent of a murdered child is entitled to and have been denied to the Millers: 1. Why wasn’t the crime scene ever documented? It was never quarantined, no crime scene photos, etc. Why did one police officer sit and another HELP Gervy Miller pull his son from the brook? Why did they not try to preserve the crime scene? Why were normal police practices not followed? 2. Where did Clayton get the asphalt from one side of his body and clothes if he was found in a brook? This has never been explained, there is no asphalt in the brook. 3. Multiple autopsies and reviews came up with 4 different conclusions: dry drowning, emphysema, exposure and a chokehold known to be used by the police. Given the condition of Clayton’s body, what is the cause of death? 4. Why were the police notes not documented until months after Clayton’s death? This fact was conceded by the police officers testimony during the inquiry. Notes are usually meticulously documented in police work for court reasons. These were not, why were normal police practices not followed? 5. Why was a judge in the Cape Breton Regional Municipality able to be swayed by a police officer during the inquiry? The police officer had no reason to interrupt the inquiry. An inquiry is for transparency – there has been none of this in this case. 6. The findings of an inquiry of the Miller case, in a 7 page summary, did not rule on the cause of death and indicated no culpable negligence on anyone’s part. Why has this case gone on for so many years, with so much documentation, sworn statements and affidavits with no resolution? 7. Why did it take so long under the Access of Information Act to receive documents that were mostly censored out, including names of witnesses, when the police force no longer exists? This is not a case of national security. Witnesses came forward. No censorship is required - what is being covered up? 8. Why have the Millers been told by the Information Commissioners office that all information from 1990 to 2000 had been destroyed? But the RCMP stated that no information had been destroyed? 9. Mayor Cecil Clarke sent a letter to the Attorney General and Minister of Justice for NS indicating he supported a review of the Miller case as the rumors of murder and police cover up tear at the fabric of our society. Why if Mayor Clarke is so concerned, did he not help this investigation and review when he was the Minister of Justice himself in 2007?
