A Challenge to Cochise County Superior Court..... The Honorable Judge Hoggat. Sir, I believe you were duped by our former Town Attorney who resigned shortly after your ruling. The facts of your ruling blatantly violate both the AZ Statutes AND the State Constitution {Article 7 Section 7}. I believe that in the interest of Justice, if I were in your shoes I would have the attorney Mary J. Ryan investigated for election fraud.... that was the result of your ruling. At the very least she should be reported BY YOU to the BAR. Even the A.R.S. you cited does not grant the authority for your ruling. Only Certificates of Election are allowed [specifically] yet you ordered Certificates of nomination {A.R.S. 16-665 (B) 3.} Your basis of calculation was solely on ballots...300, yet only 294 VOTES were cast: Article 7 Section 7; In all elections held by the people in this state, the person, or persons, receiving the highest number of legal votes shall be declared elected. So is there Honor and Justice in the County Courts? Had you allowed verbal arguments as were requested, this would have been presented. That fact that it was not presented in the original brief was due to the fact that no one with integrity would have believed that there would be such a gross misapplication of law in spite of such clear language. What steps need to be taken to bring Justice for the people of this Town. I believe there was a blatant attempt of fraud to favor the [now] Former Mayor... the worst part is that the attorney actually got paid for this injustice by the tax payers of this Town that were duped. As to the Former Mayor Robertson..... a real man would have stepped down when losing the election the first and not wasted tens of thousands of tax payer dollars just to avoid the will of the people.
