A Federal High Court sitting in Benin City on Friday struck out the prayer by the speaker of the Edo State House of Assembly, Hon Uyi Igbe, and 14 others for an order of interim injection restraining nine Peoples Democratic Party (PDP) lawmakers in the House from further purporting to carry out their legislative functions to sit or hold plenary sessions whatsoever pending the hearing of the motion on notice. The presiding judge, Justice Mohammed Liman, said the prayer of the All Progressives Party (APC) lawmakers was outside the armpit of section 25 (1) (q) (r) (s) of the constitution. On their praying the court for an order directing that time should not run during the period of 2014 annual vacation of the Federal High Court, which is scheduled to lapse between July, 12 to September 15, 2014, the court ruled that it was not necessary by virtue of order 46, rule 5 allowing for hearing of other matters by a judge at the request of the concerned parties. The interlocutory injunction shall be taken by the vacation judge on a date assigned by her or subject to the defendant filling motion to set aside the interim order, the court ruled. The court, however, granted an interim injection restraining the the first and second defendant (police) from preventing or continue to prevent the plaintiffs including the workers of the Edo State House of Assembly from having unrestricted access into the premises and their offices pending the hearing and the determination of the motion on notice. It also granted an order of interim injunction restraining first and second defendants from preventing the workers engaged by the Edo State House of Assembly from continuing the renovation and repairs to the leaking roof of the assembly complex pending the hearing and the determination of the motion on notice. PDP lawmakers will seat on tuesday. And they welcome the APC legislators to come and seat too. Roof repairers should come and fix the roof. They too are Welcome!...
