A Federal High Court sitting in Ibadan has struck out a contempt suit instituted by former chairman of Oyo State council of the National Union of Road Transport Workers (NURTW), Alhaji Lateef Akinsola, against Oyo State governor, Senator Abiola Ajimobi and the leadership of the union. The court, presided over by Justice Abimbola Obaseki-Adejumo, struck out the case on the grounds of lack of jurisdiction since the respondents had already filed an appeal against the judgment at the Court of Appeal in Ibadan. The judge said, “Since the case is already before the Court of Appeal which is a higher court, hearing the case would, therefore, amount to judicial rascality.” She added that the respondents should be allowed to exercise their constitutional rights. Akinsola, popularly known as Tokyo, had prayed the high court to commit Oyo State governor and the state Commissioner of Police to prison for allegedly flouting a court judgement that he be reinstated as the chairman of the union. He also prayed the court to commit the incumbent chairman, Alhaji Taofeek Oyerinde, also known as Fele, to prison for allegedly occupying the position illegally. But the lawyer of the NURTW, Michael Lana, held that the Federal High Court judgment delivered on May 25, 2012, did not ask for the reinstatement of Akinsola rather stated that the proscription of the NURTW by the state government was a violation of their fundamental human rights as provided in Sections 33, 40 and 42 of the 1999 Constitution.
