A couple of things to keep in mind about indictments. First--an indictment is not evidence of guilt. An indictment represents a vote by the grand jury that there is probable cause that a criminal offense was committed--and there is probable cause that the defendant committed the offense. The legal standard in the trial court is much higher--guilt beyond a reasonable doubt. I am stating these fundamental legal principles because I know that many people are talking about the Rick Perry indictments today by the Travis County Grand Jury. Expect Defense Attorney David Botsford to file motions as thick as a phone book challenging everything from the assembling of the grand jury to allegations of vagueness of the charges--along with a constitutional challenge to the criminal statutes involved.
