A former district attorneys office employee filed a breach of contract lawsuit Monday against Acting District Attorney Brian Fortner who terminated her less than 48 hours after he took office in May. Wendy Agan is listed as the plaintiff in a suit filed by Roswell attorney Natalie Woodward that seeks declaratory judgment, injunctive relief and recovery of damages for breach of contract, promissory estoppel violation of her due process rights and wrongful termination. Fortner, the Douglas County Board of Commissioners and the county personnel board are named as defendants in the suit. Agan was employed as a legal assistant with the district attorneys office from August 2001 until she was terminated on May 2. She had been under investigation by the Georgia Bureau of Investigation after media reports exposed alleged misuse of funds by the DA’s office. The lawsuit filed Monday by Wendy Agan claims that the county failed to follow the policies laid out in various sections of county merit system. Agan appealed her termination to the personnel review board on May 15. But after being granted a hearing for her appeal, she was notified on May 22 that it had been canceled based on the false assertion that the district attorneys office employees were not a participate in the county merit system, the suit alleges.
