A lettyer by me to the High Court and Bar council of M.P. The letter has ate dust. Is there any will to improve the image of judiciary by both wings that is by Bar and Bench? The President, Bar Council of M.P., High Court Building, Jabalpur, M.P. 482007. Sub: Holding of High Court sitting on every first and forth Saturday of each month. Respected Sirs, 1. My humble submission is that undisputedly there is huge number of bail applications pending in the Hon’ble the High court and long dates of about 02 moths are also given for hearing of such applications. 2. The concept is not correct that how it matters if the accused persons are in jail for such period. It is certainly a negative approach. Hon’ble Justice Krishna Ayer has rightly said that bail and not jail is a rule. Even in criminal appeals in which accused persons are under trial are not granted bail and are languishing for years together. 3. If under these circumstances the Hon’ble the High Court holds court on first and fourth Saturday of every month pendency of bail cases may be reduced to certain extent. 4. At least one Hon’ble Judge may sit for a day and dispose of bail applications. It will further be requested that the Hon’ble the Judge regularly sitting on one Bench may sit on other Bench so that the hurdle of hearing of bail applications by the same judge may not come in the way and bail applications may be disposed of conveniently. For example if Hon’ble A is sitting regularly on the Main Seat and Hon’ble B and C are sitting at Indore and Gwalior Benches respectively they may be interchanged to other Benches for this purpose. 5. The Hon’ble Judges who may render services may be given honorarium of one day salary for every extra sitting. These Saturdays are working Saturdays for the Registry therefore no extra payment for the staff is required to be made. 6. It is hopped that the Bar Council of M.P. will extend cooperation in getting justice to accused persons. 7. After completion of this mission M.C.As , M.C.Cs, etc. etc which are ripped for hearing may be taken so that the Hon’ble Judges may spare more time for disposal of other cases on regular working days. 8. It will not be out of place to state that I am not personally interested in such work as my judicial work is mostly on Civil Side and that too nominal.
