Our son passed away in Nov 2009 from Myocarditis, thirty days after receiving the 2009 H1N1 vaccine. We filed a claim with the Countermeasure Injury Compensation Program and have waited for three years for their decision. Last month we received our final denial letter. They said that although I proved a temporal relationship under CICP rules I did not prove "compelling, reliable, valid, medical and scientific evidence". The part that I thought you would find interesting is this: “Moreover, the listing of an adverse event in a vaccine package insert or during clinical trial does not constitute evidence of casualty, but rather an alert to possibility of relationship.” Pericarditis is listed on the vaccine package insert. Pericarditis and Myocarditis, both are an inflammation of the heart, Myo is the heart muscle, Peri is the outer layer.
