A shot in the arm for Rod Sims??? Not really. His track record is that hell allow even explicit reductions of competition (eg mating dinosaurs) if they promise hand-on-heart that itll help them reduce the price of their products. I think this effects test is a dangerous one. Anyone remember Two airlines agreement? One airline got new tech (turboprops) and made flying so much nicer for the passengers that the not-so-innovative competition couldnt sell any tickets. Under this effects test that would be classed as anti-competitive behaviour. Hmmm... I wonder if Qantas is behind this... Hey we dont have any 777s and we foolishly decided to put all our 787s in grey and orange, now Virgin are wiping the floor with us because they do a better job for their customers, thats anti-competitive! Trouble is its a very fine line between investment in good tech and abuse of market power.
