A sister of my acquaintance made a few very good points, in the course of a discussion that we were having. She did not name names (or even countries of those involved), but she pointed out that there are always more details than immediately come to the surface, even in cases of zina, or near-zina. A married woman is left by her husband in the country in which they both live. He goes for umrah, leaving her behind, and then decides that it will be hijrah instead. He does not return, nor did he tell her before his exodus, that this is what he was considering. He takes one or two calls from her, does not agree to give her her freedom, nor does he agree to bring her to where he is. He points out, he is now an illegal visitor where he is, and, anyway, he needs her to stay where she is, and continue to be patient, and to work, and to send him money. After a time, he does not let her know where he is, and she has ceased to send him money. The aimmah where she is will not grant her dissolution of the marriage, nor will they try to contact her husband. She is suspended, neither free to marry again, nor maintained by the one who married her. One brother agrees to help her in her attempts to locate her husband by his last known address. They talk, often, he comes by her home to assist her with some things, and they begin to be quite fond of each other. Her husband has been absent from her for nearly four years, Her husband comes home, unexpectedly, and sees his wife and the brother in an embrace. Fully clothed, but the wife admits that it was a near thing, that she did in fact almost succumb to waswas. Her husband labels her a zaniya, will not divorce her, and now her reputation is ruined, and she is still neither married nor divorced. She came quite close to an evil deed, but did not do it. Her husband has intended no good deed, but did not do an openly evil one, either, although the men are warned against leaving the women suspended. Ibn Abbas reported: The Messenger of Allah, peace and blessings be upon him, related from his Lord the Blessed and Exalted, “Verily, Allah has recorded good and bad deeds and He made them clear. Whoever intends to perform a good deed but does not do it, then Allah will record it as a complete good deed. If he intends to do it and does so, then Allah the Exalted will record it as ten good deeds up to seven hundred times as much or even more. If he intends to do a bad deed and does not do it, then Allah will record for him one complete good deed. If he does it then Allah will record for him a single bad deed.” Source: Sahih Bukhari 6126, Sahih Muslim 131 Grade: Muttafaqun Alayhi (authenticity agreed upon) according to Al-Bukhari and Imam Muslim
