A long chapter in the regulation of private poker clubs ended when the Thames Magistrates’ Court announced the closure of the International Private Members Club, following a 2 year operation by the London Borough of Hackney, the Gambling Commission and the Police. The case threw up interesting challenges regarding the regulation of private members’ clubs in general and poker clubs in particular. In passing the Gambling Act 2005, Parliament’s intention was that commercial poker should take place in the highly regulated environments of casinos, yet made provision for low stakes poker to be paid in pubs and clubs, and higher stakes poker to be played in private members’ clubs with club gaming certificates provided that there is no “rake” and that participation fees are kept at minimal levels. In 2004, the Gutshot Poker Club was opened in Clerkenwell, with its directors claiming that poker fell outside the control of the Act (and the forerunner legislation) altogether, being a game of skill rather than chance. That argument was ultimately defeated in the Court of Appeal in 2008, when the club’s director Derek Kelly lost his appeal against his conviction for the organisation of gaming. The answer is that poker a game of mixed chance and skill, which satisfies the definition of gaming in the Act. Following that, the club applied for a club gaming certificate from the London Borough of Islington, but this was refused on the grounds that the club was not a private members’ club and was established mainly for the purposes of gambling. Shortly thereafter, an application was made in Hackney for a club premises certificate under the Licensing Act 2003, the application stating that the club would be devoted to chess, draughts, backgammon, Sudoku, bridge, scrabble and pool. The certificate was duly granted. This enabled a fast track application under the Gambling Act 2005 for a club gaming certificate, with no consultation of the Gambling Commission, which was also duly granted. However, a series of inspections from 2010 to 2012 demonstrated that the club was overwhelmingly a poker club, with evidence that admission could be obtained without membership, and that fees and charges were applied in excess of those permitted under the Gambling Act 2005 and gambling regulations. In October 2011, the Licensing Sub-Committee of the London Borough of Hackney withdrew both certificates. Although the club appealed, on the first day of a three day trial it withdrew its appeal and agreed to pay the Council costs of £18,000. The case revealed the need for vigilance on the part of licensing authorities as to whether private members clubs are operating for their claimed purposes, and whether gambling is taking place in accordance with the rules governing the activity. This case came to a successful conclusion because of joint working between the national and local regulator so as to mount a compelling case that the mark had been seriously overstepped.
