A very good hypothetical question was posed to me this morning. Would Oscar Pistorius have been prosecuted for murder had he, in fact, shot an intruder in the exact same circumstances? That is where this case hangs right now: that it wasnt his negligence in failing to secure Reevas whereabouts that is at issue so much as his gross negligence in shooting first, shooting at an unknown target through a door, shooting four shots using the bullets he did in contravention of SA gun laws regarding self defense.
