ACCUSED OF A CRIME, BUT NOT NECESSARILY GUILTY: Recently, I had a client who was charged with the crime of DUI in Knoxville. If he had been convicted, he would have received at least 48 hours in jail, a suspended drivers license for a year, fines and court costs that would exceed $750.00, and an incredible rate increase in his car insurance, plus probation and the supervision fees that go along with that. After almost a year of hard work on his behalf, I was able to obtain a dismissal of charges for him. He was elated and I was pleased, obviously. Which brings me to my point, just because some is accused of misconduct, or even criminally charged, does not mean that person is guilty. That underlies our whole criminal justice system, and is embodied in our Constitution : A person is presumed innocent until proven guilty. Even on a much smaller scale, a week ago I represented a woman on a Failure to Yield charge arising out of a traffic accident. Iif convicted she could have faced increased liability if she was sued in civil court, and she too would likely have incurred a significant increase in her car insurance. After our trial, the Judge dismissed the charge. If you, a family member, or friend face any type of criminal, or traffic related charge, strongly consider hiring a competent attorney to protect you in those matters. Innocence matters !
