AG buddy Caldwells good government tort reform proposed amendment to HB 799 by Representative Stuart Bishop: Notwithstanding any statute to the contrary, including La. R.S. 39:1533, 39:1535 and 39:1538, in any suit or any pre-litigation investigation of potential claims first approved by the litigation subcommittee of the Joint Legislative Committee on the Budget, and subsequently brought by the attorney general on behalf of the State as plaintiff through special attorney or counsel, the Office of Risk Management shall pay the special attorney or counsel all attorney fees, costs, and expenses in the same manner as other suits provided for by La. R.S. 39:1527 et seq. The attorney general shall have the sole and exclusive authority to manage all litigation decisions including but not limited to decisions regarding strategy, trial, settlement, and appeals. The amount of attorney fees are not to exceed five hundred dollars per hour.
