THANKS TO OUR COURTS IN PNG ///////////////////////////////////////////////////////////////////////////////////////////// COURT STOPS ACTING OMBUDMANS POSTING August 11,2014, 04:12 am By JACOB POK The National Court has stayed the recent decision on the appointment of Howard Maliso as acting ombudsman by the ombudsman appointment committee. The court issued the order last week following a judicial review application filed by the Ombudsman Commission challenging the decision of the appointing committee. Mr Maliso was sworn in as acting ombudsman early last month at the Government House by Governor-General Sir Michael Ogio. His appointment was in the National Gazette and took effect on July 4. However, the commission asked the court to review the decision on the basis that there were several procedural errors and flaws in the appointment process. The respondents named in the proceedings are members of the ombudsman appointment committee, comprising Prime Minister Peter O’Neill, Chief Justice Sir Salamo Injia, Opposition Leader Belden Namah, MP Philip Undialu as chairman of permanent parliamentary committee on appointments and Philip Kereme as chairman of the Public Service Commission as first defendant. Mr Maliso and the State were named as second and third respondents. The judicial review court found that there was an arguable case to be tried and so granted leave to the commission to pursue the matter. The court ordered, amongst others, that leave be granted to the plaintiff (OC) to apply for judicial review of the decision by the ombudsman appointment committee on the appointment of Mr Maliso. It also granted an interim injunction restraining the respondents from exercising or implementing any action or decision that may interfere with the work of the plaintiff until determination of the proceeding. The court further issued an interim injunction restraining Mr Maliso from taking office as acting ombudsman and exercising powers of that office until the determination of the proceeding. The matter was adjourned to Friday 22 August at 9:30am for directions hearing.
