AN OPEN LETTER TO PRESIDENT ICAI & CBDT CHAIRMAN Lakhs of tax payers, CAs and advocates await every year for release of the ITRs, Audit Formats and effective Schemas by CBDT to enable e-filing from the month of April itself. But so far, there is no certainty about time of its release by CBDT. Resultantly, the assessee is deprived of his fundamental right and find him helpless, if he wish to e-file his ITR in April. The auditors cant file TARs in April, even if they so desire. Why not make it possible? We suppose that the whole process of filing TAR and ITR should be effectively in place on April 1st invariably every year. It is also the intention of legislature and right of every taxpayer. And such, all the ITRs and Formats should be released and enabled for e-filing by CBDT latest by 1st of April every year. So as lot of precious time of CAs and advocates not wasted every year in waiting of formats or schema, or due to revision of utility. We hope that the ICAI/ DTC is certainly looking to resolve this issue of great concern, in order to ensure that the taxpayers and CAs dont have to suffer anymore for the ineffective planning and delay made by CBDT year after year. We suppose that the practices of CBDT to be more tax payers friendly and timely to avoid recurrence of undue hardships faced by lakhs of tax payers, CAs and advocates every year. Kindly update us, if you have some inputs. Or it should be our fate to suffer every year for ineffective plannings by CBDT. Further, there is no clarification from CBDT even after 4 days about the applicability of extension of TAR to ITRs u/s 139(1) making the members confused to choose proper action plan. And the due date u/s 139(1) is approaching fast. Any urgent official announcement from ICAI to clear all these issues and updates about status as of now in these matter will be highly appreciated by the members. It is also urged to kindly inform us on regular basis about with valuable inputs and updates from your end, to clear the uncertainties as well as for our timely guidance in discharging our obligations towards society. Or should we take it as our fate to suffer every year for the ineffective planning, arbitrary orders and delayed release of forms and schemas by the CBDT. DILIP KHETAN , GORAKHPUR
