IS AFRIKANER SELF-DETERMINATION STILL A PIPE DREAM......OR THE ONLY OPTION ? - Chris this year will see TRADE and Industry Minister Rob Davies bring two economically devastating pieces of legislation to Parliament — two more hammer blows to the head of our economy. The first is the Promotion and Protection of Investment Bill. The irony is that while the bill’s name suggests protection of investment, in practice it will do the very opposite. If the bill is enacted as it stands, it will offer very little if any protection to foreign-owned companies that have invested in SA. At present certain corporations are afforded protection by treaties between SA and the countries where the businesses are based. Such treaties conform to international norms and standards of investment protection, including property and assets, and are an integral part of attracting and retaining foreign investment. This bill allows for such treaties to lapse so the protection they provide through international courts and organisations such as the World TRADE Organisation falls away. This will inevitably result in job losses as foreign companies begin to disinvest. For example, German companies employ about 90,000 South Africans, with the potential to invest further and create more jobs. It seems the government is willing to sacrifice these jobs to calm fears of foreign interests by those in the African National Congress (ANC) who think the West is out to recolonise Africa. The second problematic piece of legislation is the Licensing of Businesses Bill. It has to be one of the most draconian, apartheid-like pieces of legislation that the ANC government has brought to Parliament. It suggests that all businesses, from spaza shops to JSE-listed companies, will have to register with their municipality and receive a licence to operate. this bill will only create more ROOM for corrupt municipal officials. Moreover, the bill has the potential to take away business owners’ rights to legal recourse, as municipalities will be the final arbitrator in terms of compliance with the bill.
