This is the only governing body with the power to grant, refuse or cancel visas. They can also assist you in various visa applications and provide you with information on your rights and obligations as a migrant worker or Australian visa holder. The Fair Work Act 2009 The Fair Work Act 2009 entitles every worker in Australia the basic rights and protections in the workplace. Through the Fair Work Ombudsman, you can lodge a complaint against your employer if you feel that your rights as a migrant worker are not being fulfilled. The Fair Work Ombudsman The Fair Work Ombudsman assists employees, employers and contractors to understand the rules governing the Fair Work Act. They can provide information and advice to help resolve issues and complaints at work by conducting investigations and enforcing Commonwealth workplace laws. With help from the Department of Immigration and Border Protection (DIBP) and the Fair Work Ombudsman, you can better understand your legal rights as an overseas worker. The National Employment Standards (NES) Under Australian Law, all employees are provided with 10 minimum employment entitlements referred to as the National Employment Standards or NES. The NES ensures that migrant workers have certain minimum conditions of employment, regardless of the type of working visa they hold. These entitlements include: maximum weekly hours; requests for flexible working arrangements; annual leave; parental leave and related entitlements; personal carers leave and compassionate leave; community service leave; long service leave; public holidays; notice of termination and redundancy pay; and Fair Work Information Statement.
