Aarhus University, INTRAlaw, Denmark Vacant PhD and Postdoc Positions Application deadline: 14 April 2014 The Department of Law, School of Business and Social Sciences, Aarhus University, is recruiting a PhD candidate and two postdoc scholars to join the research centre INTRAlaw - International and Transnational Tendencies in Law. Thanks to an external grant, INTRAlaw will be established as of 1 April 2014 as a research centre exploring the contradictory tendencies of integration and harmonisation of legal norms on the one hand, and pluralism, polycentrism and fragmentation of legal systems on the other. The research activities of INTRAlaw will primarily be focusing on four subthemes: INTERACTIVE LAW: Interaction between different normative systems such as international law, EU law, and national law, aiming to illustrate how external norms can be used or reformulated in a local, national, regional or international context. Due to the commonalities of the legal systems in the Nordic countries, the project focuses in particular on this small, but quite uniform region. COMMERCIAL LAW: Transnational norms in international trade, aiming to elucidate whether and how transnationally recognised principles have influenced Danish legislation, case law, legal doctrine, and the actual drafting of domestic and international contracts by Danish companies. HUMAN RIGHTS LAW: The application of human rights obligations in transnational exercise of authority, whether conducted by State institutions or by private actors, in such contexts as armed conflict, anti-terror and anti-piracy measures, and migration control, including State responsibility as well as possible extension of obligations and responsibility to non-State actors. LEGAL DEVELOPMENTS IN THE ARCTIC: The Arctic, and in particular the Greenlandic situation may illustrate the emergence of a complicated relationship between international law, informal international governance by the Arctic Council, EU law, Nordic/national law, Inatsisartuts legal acts and the Inuit traditional law. DESCRIPTION: INTRAlaw offers one PhD scholarship and two postdoc positions beginning 1 July or 1 September 2014. The PhD candidate will be enrolled in the 3 year programme for PhD candidates in Law, while the postdoc scholars will be employed for 2 years and 3 months including certain teaching obligations in related areas of law. TOPICS: Applications are invited from candidates with project proposals and/or academic profiles within one or more of the subthemes mentioned above, or otherwise focusing on international and transnational tendencies in law. Project proposals with a focus on the following topics and questions pertaining to the various subthemes, or across these subthemes, would be of particular interest to INTRAlaw: INTERACTIVE LAW: For a PhD candidate we are particularly looking for projects which can provide new empirical and theoretical insights into the causes, consequences and interactions of when, why and how international law and EU law has influenced Nordic national law and legal thinking. Research within this subtheme is problem-driven and focused on salient empirical and theoretical issues with the goal of providing basic scientific knowledge of the impact of international law on politics and society in the Nordic states. The successful candidate for a postdoc position is expected to engage in various collaborative research activities within the legal work-package of the project, addressing theories on legal families and different substantive areas of law. Projects could include a variety of questions such as: What constitutes a legal family and how can existing theories on legal families explain the interaction between different normative systems? To what extent are different areas of substantive law affected by international normative systems, and are the Nordic legal systems in any way influencing international legal thinking? How can Nordic legal actors develop legal strategies in order to influence international legal orders in the future? COMMERCIAL LAW: A PhD or postdoc project could be a study on how transnational and international commercial contract law and practice develops and influences the contracts concluded by Danish companies, and the impact on court decisions, legislation and on legal scholarly writing. The study may focus on tendencies in general or analyze a specific branch of industry or certain types of contract clauses. The effects of the internationalization should be related to different legal theories, principles for interpreting contract clauses and traditional legal methodology. HUMAN RIGHTS LAW: A PhD or postdoc project could examine the complex questions arising from the formal or de facto exercise of State authority by non-State actors beyond the borders of the delegating State: To which extent are States human rights obligations applicable in such transnational settings? How can human rights norms be enforced extraterritorially against the background of legal and factual obstacles to the functioning of ordinary control mechanisms? On which basis may State obligations extend to non-State actors in the transnational context, and which legal challenges and regulatory changes may arise in connection with the potential direct responsibility of private actors? In addition, what are the theoretical implications of various transnational tendencies to the traditional assumption that international human rights obligations are founded in the sovereign States? LEGAL DEVELOPMENTS IN THE ARCTIC: A PhD or postdoc project could examine the complex questions arising in the Arctic Region in the light of environmental and security requirements focusing on the following: To which extent is the regulatory framework based on international standards? To which extent may short-term economic interests have a special impact on the decision-making on licensing, approving, etc.? Are the private corporate actors playing an important role in the complex regulatory environment as rule-takers and rule-makers? PROPOSAL DETAILS: Research proposals should clearly set out a research question, possibly with relevant sub-questions; information on the theory/ies informing the research; methodology/ies to be applied, including whether and what kind of empirical work will be involved; the state of the art, and the projects add-on to the present knowledge and theories within the field.
