After weeks of calling bluff, PDRM had taken action by arresting members of PPS that had participated in the Merdeka Days parade. Formed by the current DAP led state government, PPS is believed to be having 10,000 members divided into 40 units. While Lim Guan Eng is crying foul that PPS is a legally registered body under the state govt and does not require to be registered under Societies Act 1960, I beg to differ. I will not argue about the non-registration of PPS. But even if the body is legally registered with PPS, PPS by all intent and purpose is still an illegal organization. Lets go into the purpose of the formation of PPS. PPS was formed purportedly to provide voluntary security services in Penang in view of the rising crime rate. Our Federal Constitution is the supreme law of the land. Any other laws, be it enacted by the Federal Govt, state govt, or local council, must not be in conflict with the Federal Constitution. In the Ninth Schedule of the Federal Constitution, internal security is listed as item 3 under List 1 - Federal List. With this, state government doesnt have the right to form a vigilante group to enforce law and order. I was made to understand that supporters to PPS had pushed the following 3 points in arguing for legality of PPS. 1. Why is Johor allowed to have a military force of its own in the form of Johor Military Force (JMF)? 2. Why can Federal govt form Rela? 3. Why can other states have JKKK? I will try my best to enlighten why these are different. JMF Before Malaya obtained her independence in 1957, the whole of Malaya was under British colonial rule, except for Johor. Johor was the only independent nation in the region other than Thailand. As such, she has her own military force. Upon the formation of Malaya, Johor was allowed to keep JMF in return of surrendering her sovereign to Malaya. However, JMF was relegated from a sovereign military branch into a ceremonial unit and the principal role of providing close protection service to the Johor royal family and guests in 1994 under . Rela and JKKK Rela was formed under the purview of the Home Ministry and thus is part of the Federal Government. In fact, Rela and JKKK both sits in the state level National Security Council. Thus, both are part of the Federal Govt and not state government. How about PPS? PPS is believed to report to the State government, but there seems to be lack of information of who they are. There are no legal body that govern them. Formation of PPS itself is fraught with questions. Who are these volunteers? Who vetted their backgrounds? What are the rules and constitution of the movement? What training that they need to attend? None of these questions seems to have an answer. Worse, the PPS itself reminds me of another so-called security service, a security service, a security service that we all know as Sturmabteilung or SA.
