Amash Stands Up Against NSA Surveillance For the record, and lest we forget it, here is the text of one of the most brilliant pieces of legal writing ever created, in my opinion, the Fourth Amendment: "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." Does this protect our private communications? I argue yes. I believe, based on the 9th Amendment, that we should interpret individual rights found in the Constitution very broadly. (Government power, on the other hand, should be interpreted narrowly). The 4th Amendment protects our "effects," which are our personal belongings. This includes those of our personal communications that we wish to keep private. Also, our "papers" in the 4th Amendment refers to our private documents, which should still be private even if they are now in electronic form and no longer printed on paper. reason/archives/2013/08/01/rep-amash-leads-libertys-backlash
