Amid confusion, ECI says MCC no more applicable in JK 12th Assembly to be constituted on Dec 30: Law Secretary As Jammu and Kashmir government is awaiting the Election Commission of India’s directions over lifting of Model Code of Conduct, the poll body Saturday said the MCC is no more applicable to the State. “MCC ended the day (when) all results were announced and is no more (applicable) now,” Deputy Election Commissioner Vinod Zutshi told . ECI spokesman Rajesh Malohtra also said the MCC ended on the day of counting. The disclosure comes at a time when confusion prevails in the administrative circles of the State over applicability of MCC. The state government had also approached the Chief Electoral Officer to know whether the MCC is in vogue but did not get any answer. The MCC was applicable in the State since October 25, the day when the poll body announced schedule for the five-phase assembly polls in JK. The counting of votes for all 87 seats took place on December 23. Meanwhile, the State government today said the new assembly would be constituted on December 30. “A notification for constitution of 12th Assembly would be issued on December 30,” State’s Law Secretary Muhammad Ashraf Mir told this newspaper. The notification, he said, would be issued under Section 82 of Jammu and Kashmir Representation of Peoples Act-1957. The results declared on December 23 have thrown up a hung assembly with no party getting a clear majority. The opposition Peoples Democratic Party emerged as the single largest party by bagging 28 seats whereas BJP finished close second with 25 seats. National Conference and Congress respectively bagged 15 and 12 seats whereas others got seven seats.
