And, this one goes out to all of my landlords out there: Make sure that your residential leases are written in plain English without legalese. If your lease contains too many “wherefores” or inconsistent remedies that are not easily readable or understandable, you run the risk of violating The Plain Language Act. Any Provision that is found to be a violation of this act is unenforceable against your tenant. Fortunately, The Office of Attorney General Bureau of Consumer Protection will (without charge) review your lease to make sure that it is incompliance with the act. Although the Attorney General’s preapproval does not mean that the lease is illegal or unenforceable on other grounds, this is a great first step to make sure that your contact is simple, understandable, and not in violation of the Plain Language Act.
