Another abuse of authority and power caught on camera! OFFICIAL STATEMENT BY DEPARTMENT CONTRADICTS SUPREME COURT! “The Hammond police officers were at all times acting in the interest of officer safety and in accordance with Indiana law… In general, police officers who make legal traffic stops are allowed to ask passengers inside of a stopped vehicle for identification and to request that they exit a stopped vehicle for the officer’s safety without a requirement of reasonable suspicion.” In Hiibel v. Nevada the United States Supreme Court considered the constitutionality of an arrest and conviction based on the failure of the defendant to identify himself to police during a valid “Terry-Stop.” As such, Hiibel would not justify his arrest since the rule from Hiibel requires that the person(s) being asked to identify themselves must be the subject of a valid Terry stop, i.e. they must be suspected of criminal activity and that suspicion must be supported by reasonable suspicion. The mere fact that he was a passenger is not sufficient as reasonable suspicion so failing to provide identification is not valid charge for an arrest. A passenger is not required to have identification on their person! The only violation is an unwritten law known as CONTEMPT OF COP by challenging authority.
