Another interesting moment this morning in the #PistoriusTrial: the defence attempts to cross-examine a state witness (crime-scene photographer) on a photograph taken at the crime scene. The prosecution objects to the photograph on the grounds that (a) the photograph wasnt taken by the witness on the stand, (b) the photograph has not been proved by a witness, and (c) they dont know where the defence got the photograph from. The prosecution asks that the photograph is only allowed if the defence later prove it by calling the photographer who took the picture. The defence assert that the photograph was disclosed to them by the police so they cannot be responsible for proving it and they dont know whether or not the prosecution is intending to call the taker of said photograph as a witness. Judge decides to allow defence to ask witness what he knows about the photo and go from there. Defence, during cross, divulges details of who the police say took the picture (the ballistics expert) and that the photograph times overlap with those taken by the current witness, who has stated categorically that he was the only one on the scene taking pictures. (This explains yesterdays request for photographic meta-data to be produced to court). One observer points out that Gerrie Nels [prosecutors] ears have gone bright pink.
