Any suggestions ? Preparing my piece for International Internet Law Conference on presentation of electronic evidence at trial. Session 4: understanding technical issues and presenting electronic evidence This session will address the question of how to gain a better understanding of the sometimes complex technical issues at stake in a case, and how then to best convey that to a relatively uninformed audience (including some judges). This can pertain to technical evidence of website blocking but also includes issues around how to present ‘digital evidence’ and ensure that it is not tampered with. Specific discussion points include: - How to present technically complex issues in a simplified manner, while maintaining the requisite level of detail/sophistication to properly argue the case? - How can experts/expert reports best be used to explain complex matters? - Examples of best practices/unsuccessful attempts from your jurisdiction? - Examples of what judges appear to struggle with most -- are there common themes or is it highly individual?
