Article 36 of the Zambia Constitution. .. WHEN CAN A MEDICAL BOARD BE SET UP TO INVESTIGATE THE PRESIDENTS PHYSICAL /MENTAL STATE? 1 .The decision must be made by Cabinet in its discretion. 2. The motion must be moved by Cabinet and the vote MUST be by majority vote. 3. At least medical doctors must be involved 4. Report goes to the Chief Justice who in turn must Report to Parliament. 5. Once Cabinet has passed such a decision, the President ceases to perform Executive functions As the Vice President will discharge such duties. 6. If the Vice President cant perform the duties then Cabinet appoints amongst its own. 7. Such a Cabinet minister can not make any new Appointments/ disappointments or dissolve Parliament. This is the same as being an Acting President. No real power.... 8. Article 36(4)....is crucial....Such a motion may only be proposed at a Cabinet meeting. Ignorance is a very dangerous game to play. Someone I have heard and read has moved a motion in court for Judicial review to compel Cabinet to move the motion of setting up a board. HOW?? Well, this can only be done by an order of Mandamus by a court. But such an order is only possible if it can be shown that Cabinet was asked...to do this. Cabinet sat and refused to take such a decision. The problem I see with such a court action is that the evidence should have been before Cabinet ...and Cabinet failed to act on Prima facie evidence.Now, is there evidence of such evidence having been given to the Cabinet ...and a decision was not taken ?? Matters of National interest are not to be taken at face value just because someone wants some headline... Please do not misunderstand me. Is Sata sick ? Yes he is...Is he very sick ?? Maybe. Is he failing to discharge his functions ? There is NO EVIDENCE TO SUPPORT THIS... Let us talk politics. Who is pushing this agenda? Who ultimately stands to benefit from all tjis?? You do not need to be a rocket scientist to guess. ..EVER HEARD OF THE CARTEL?? THINK...IT IS A SET UP!! Who took the President to court in a sick state? ...Hellow? Who wanted that exposure?? Who was enjoying the court melodrama?? Let the games begin....Wanna play??
