As you may be aware, the European Court is currently investigating the legality of social charges levied on non resident French property owners on rental income / capital gains tax. The situation in brief Since 2012 non resident French property owners have paid social charges in France on both rental income and capital gains. It is argued that these social charges have sufficient link to the French social security system to make them infringe European regulations which state that EEA residents should only pay social security charges in one member state. Since residents pay social security charges in the country in which they live, the argument is that non French residents should not be paying any social security charges on their property in France. Although the final ruling on this is not expected until next year, the Notarial Center of Fiscal Assistance (CNAF) has advised that it may be possible for those affected to make a retrospective claim on these charges
