Asymmetric Federalism By virtue of asymmetric or administrative federal government mechanism under the Parliamentary political system the executive head of the nation (union) either must be directly elected by the people of the union or must be declared by the political party(s) as the candidate while contesting in general election. This is not clear in the NCUML common proposal. Similarly, under the asymmetric federalism the judicial council of the central government cannot appoint the judges of the federal states or regions. Under asymmetric federalism states have rights to self-determination and autonomy to form their own executive, legislative and judiciary bodies of government. Therefore, states or regional governments have right to form their own judicial council mechanism. The NCUML common proposal has thus overruled the rights of state or regional governments to their own judicial council mechanism. These two elements of the proposal undermines the fundamentals of federalism.
