At the continuation of the motion hearing yesterday, Prosecutor Kowal admitted on the record that a Wayne County Sheriffs Deputy AND a prosecutor from her office viewed privileged information between Notoriano and Pomeroy and their attorneys. The information was on the phone records she obtained over a year ago and has kept it hidden until yesterday. Judge Slavens immediately ruled that the records will be excluded unless attorneys for Dave and Mike find that they contain exculpatory evidence. We believe the records do contain helpful and truthful information and THAT is the very reason Kowal has kept it hidden all of this time. However, she claims that she has not viewed the information herself. The Judge scolded Kowal for her handling of evidence, lack of preparation and failure to comply with turning over reports to defense attorneys. A remedy for Kowals gross misconduct in the handling of evidence was discussed and it was recommended that a dismissal of the case should be the remedy. As of this time, no action has been taken. Judge Slavens also ruled to have two separate trials in this matter with Pomeroys starting on January 13th and Notorianos starting immediately after. Please continue to pray for the guys and their families. Battling a very corrupt prosecutor since July of 2013 has been rough to say the least.
