Attaching a copy of The establishment of permanent benches of High Courts at State Capitals Bill, 2014 which I plan to introduce in the Parliament today : THE ESTABLISHMENT OF PERMANENT BENCHES OF HIGH COURTS AT STATE CAPITALS BILL, 2014 Introduced in the Parliament on 12th December 2014 The Establishment of Permanent Benches of High Courts at State Capitals Bill, 2014 will the establish a permanent seat of the High Court at State Capitals of those states where the principal seat of the High Court is situated at another place within the state. For example, the principal seat of the Kerala High Court is at Ernakulam, which is situated at a distance of 200 Kilometers from Thiruvananthapuram, the capital of the State of Kerala. The Bill will ensure that the permanent seat of the High Court of Kerala is at Thiruvananthapuram, its State Capital. A State is a litigant in a number of cases and proceedings pending before a High Court. Consequently, States which do not have the principal seat of the High Court at its capital spend a substantial amount of resources in providing for the travelling and leave allowances of its employees who have to appear before the Court for their depositions. Moreover, it has been the policy of successive Governments to ensure ease and accessibility of justice for litigants and therefore the litigants and witnesses should not be compelled to travel long distances to reach the Court. In order to balance the administrative and legal duties of its employees, the Governments of such States lose considerable time and money. The frequent absence from duty of Government officials deputed to testify in Court is also a major cause of administrative inefficiency. A reform calling for the establishment of a permanent bench of the High Court at State Capitals is required to deal with delays and provide for access to justice. Therefore, it is necessary to enact a legislation providing for such a mandate on the recommendations of the concerned State Government.
