Attempted kidnapping of a child mere feet from his/her mother. Three criteria for Deadly Force in the state of Indiana: 1) Ability. The bad guy has to have the ability to cause severe bodily injury or death to you or another person. 2) Opportunity. The bad guy has to have the opportunity to cause severe bodily injury or death to you or another person. 3) Jeopardy. You or another have to reasonably fear serious bodily injury or death. Watch this video...the bad guy just walks away. Should he have been allowed to walk away? Or should that mom have drawn her weapon? She clearly has no weapon and no training. Too bad because this could have gone down a LOT differently and she and her child just got very lucky. My take as a responsibly-armed citizen: Its reasonable to think that an bad guy who is that brazen could be armed. At that distance, he could produce a knife or gun and fatally strike either child or mother in less than 2 seconds. Its reasonable to see the size/strength discrepancy between the bad guy and the child or the mother. The bad guy could easily do serious bodily injury to the child or the mother at that distance with or without a weapon. Its reasonable to fear for the life of your child here at the very least, if not fear for your own life or even the lives of others. Im not a lawyer. But I am a parent. And I am well-trained. If this was me, my Glock would have been pointed at the dudes head in roughly 1.25 seconds (average cold concealment draw for me). Id tell him to let go of my child and I would be saying that in the meanest, loudest and most aggressive voice you can imagine. If he did so, I would get my family behind me immediately. I would prone him out and have him waiting for the police. If he refused or acted aggressively in any capacity... Deadly Force authorized. At that distance, in that scenario - it would make for an easy CNS shot. If you do that, you have to do it immediately. If you wait even a split second you could have a hostage situation (in which case you still take the shot - but its not a situation you want). Once hes down, Id then scan for more bad guys while moving my family to the hardest/closest cover I could find and be yelling to call 911, that I was a legally-armed citizen and that the bad guy had tried to kidnap and harm my child. I would be yelling that I feared my childs life. I was scared for my childs life!. He was trying to kidnap my child! He tried to hurt my baby girl! Im a legally-armed citizen - please call 911 right now!! And I would keep repeating those words, maintaining situational awareness and control of my 360 environment until the calvary showed up. And then you just do what they tell you to do. Make no mistake - its the worst day of your life. But in a situation like you see on this video - more times than not...somebody in that video doesnt get a tomorrow.
