To: Mayor Joseph Petty From: Rich Aucoin and Susan Serpa, Act Now Worcester Dear Mayor Petty: The pain and frustration that led local civil rights activists to stage a disruptive road blockage on MLK Day can be explained in five words: They dont care about us. In our conversations with the street protesters, we have tried to persuade them to instead work within the system; cooperate with city officials in good faith to enact legislation which protects the rights of minorities in our city. We led by example this week by submitting our equal due process rights resolution and we persuaded several of the protesters to join us at next Tuesdays council meeting. Now we learn that Solicitor David Moore has blocked this resolution by claiming, incorrectly, that the Council lacks the power and authority to defend the civil rights of Worcesters residents. According to the solicitor, Worcester officials have no choice but to lay down and accept unconstitutional human rights violations passed by rogue politicians who dont even represent us. The solicitor appears unaware of this Commonwealths proud history of refusing to abide unlawful nullifications of basic rights, such as our citys repeal of the 1774 Intolerable Acts and our Commonwealths repeal of the federal Fugitive Slave Act. In addition to plenty of historical precedence for local governments blocking unlawful federal human rights nullifications, we also have current-day precedence as seen in Albany, NY and several towns here in Massachusetts which have banned NDAA indefinite detentions within their jurisdictions. Congressman Jim McGovern has commended those towns and encourages others to stand up as well. Our founders built a system of checks and balances throughout the U.S. government to ensure survival of our natural rights even if some officials betray us. An essential component of this system is the Oath of Office, which must be sworn by all elected officials, including local office holders. Having voluntarily sworn your oaths, you are duty bound to intercede on behalf of your constituents whenever our Bill of Rights comes under attack. So, you are faced with an ethical decision: Will you keep your oath to uphold and defend our constitutionally enumerated rights or will you hide behind an unelected lawyer who apparently lacks understanding of our bottom-up system of constitution enforcement. The last thing we want to have to do is admit to the protesters that they were right about Worcester; that the city doesnt care about their rights and that shutting it down is the only option remaining. We hope that you will prove the protesters wrong; begin the healing process by following Albanys lead and passing this civil rights resolution unanimously. Susan Serpa & Rich Aucoin Act Now Worcester
