Autopsy photos, public records case; court hearing Monday PUBLIC RIGHT TO KNOW vs FAMILY PRIVACY - Widow, daughter ask court to prevent release of autopsy photos - Apparent suicide of CBP agent, near Douglas, raises questions ======= John D Anthony was an undercover investigator for Dept of Homeland Security, U.S. Cutoms & Border Protection. On June 2 of this year, at mid-day, he was found dead in an unmarked locked vehicle near the Douglas, AZ campus of Cochise College. The legal action, brought by the Anthonys, seeks to stop the Cochise County Sheriff from releasing autopsy photos which may be in the CCSOs possession. David Morgan, Publisher of the COCHISE COUNTY RECORD, requested the investigative reports including crime scene and autopsy photos. The Pima County Medical Examiner released the written report but withheld photos. The CCSO released some crime scene photos but blocked out portions which, they said, include images of Anthonys body. The Pima County Medical Examiner found the cause of death to be a single gunshot to the head. CCSO Crime Scene Investigator Jim Adams indicated in his report that the agents handgun appeared to have been used. In a secure compartment in the rear of the unmarked red SUV [licensed in the name of a Tucson sign company] were files and supplies, including a portfolio-binder with the logo/inscription reading . . . Border Corruption Conference, Tucson, Arizona 2011 Morgan argues that the photos are public records and release is particulary important in this case. His objection to the Permanent Injunction includes argument against in camera review as a requisite before release. Federal agencies, including the FBI, took the lead on the investigation. Another case and hearing is pending in the Pima County Superior Court in which the Anthonys seek to stop the Pima County Medical Examiner from releasing the autopsy photos. Attorney Robt Stachel of Sierra Vista represents the Anthony family.
