B.J.P. vis-à-vis Janta Party ********************** History always repeats itself: it is another matter that because of the vast difference in the circumstances, people fail to make a comparison between the past and present. After dark days of emergency, when the disparate conglomeration of different parties, known as ‘Janta Party’ came into power, it was generally believed that Congress had been effaced from Indian scene for ever. So much so that the whole Indra Gandhi family was planning to flee the country, and so their passports were impounded. Those associated with legal profession may understand it better, that when the impounding of the passports was challenged before the Supreme Court,, Justice P.N.Bhagwati delivered a landmark judgement in ‘ Maneka Gandhi vs Union of India, A.I.R.,1978, S.C., which radically changed the traditional interpretation of the phrase, ‘ Procedure established by law’ used in article 21 of the Constitution and brought it at par with ‘the American Constitution’s due process of law’. The government had established Justice Shah Commission to probe the excesses committed during emergency. However, the intractable differences between the Janta Party constituents, coupled with the perpetual persecution of Mrs. Indra Gandhi and her family generated a sympathy wave in her favour and the rest is the history. Almost the similar phenomenon is presently unfolding. If the leaders like Yogi Aditya Nath, Sakshi Maharaj, Praeen Togadiya, Sadhvi Niranjan Jyoti and many of their ilk are treated as star champions, it may inevitably initiate unification process among the non-B.J.P. outfits, though not based on any ideology, but spurred by a common enemy. Besides, it may once again throw those who are totally disenchanted with the fiction of secularism back into its lap just for their survival. ************************************* Dr.Mustafa Kamal Sherwani Lucknow, U.P.
