ILLINOIS REVIEW crossroads of the conservative community MONDAY, JANUARY 26, 2015 BREAKING: FOR THE GOOD OF ILLINOIS TO FILE LAWSUIT TUESDAY AGAINST COLLEGE OF DUPAGE BOARD GLEN ELLYN, IL - A lawsuit will be filed in DuPage Circuit Court Tuesday morning against the College of DuPage Board of Trustees, saying they violated the Open Meetings Act, says a press release from For The Good of Illinois transparency group. “Tomorrow morning, For The Good of Illinois, Adam Andrzejewski, and Edgar County Watchdogs will file lawsuit in DuPage County Circuit Court alleging that an Open Meetings Act (OMA) violation occurred last Thursday while the board conferred the severance package for Dr. Breuder, the release says. In anticipation of the lawsuit, the group says, the college has called for a special meeting on Wednesday at 7 PM for a revote. The College of DuPages website says the board has scheduled a Special Board Meeting to discuss a fourth addendum to the retirement compensation agreement voted on last Thursday. That addendum, the website says, would move President Robert Breuders retirement date up to the end of March 2016, instead of June 30, 2019. Scheduling another vote this week will not be enough to correct the Open Meetings violations the Board may have encountered thus far, For the Good of Illinois says. Our legal counsel Timothy Elliott of Rathje Woodward in Wheaton has also included in our lawsuit that the remedy for OMA violation must include a venue change, the release says. The special meeting must be moved to a room large enough to accommodate the anticipated large crowd. This is in keeping with the Illinois Open Meetings Act. Andrzejewskis group encourages citizen participation at Wednesday nights meeting. We call on all citizens and stakeholders to use their right of a three minute public comment to ‘citizen filibuster’ this egregious pay and perquisite package, he said in an email to Illinois Review. With hundreds of citizens weighing in with concerns, we hope the board comes to its senses and stops the nonsense. Dr. Breuder’s voluntary retirement should not come with a $762,868 lump sum payment.” The College board posted the contents of the agreement on the schools website Monday afternoon says that the College will (1) upon Dr. Breuder’s retirement, pay him a lump sum payment of $762,867.77; (2) upon Dr. Breuder’s retirement, he will receive the retirement benefits provided to all administrators as set forth in the College of DuPage Senior Management Team; (3) the Board will install a sign on the Homeland Security Education Center consistent with the Board’s action on May 7, 2013, naming the building in Dr. Robert Breuder’s Item 6) January 28, 2015 honor; (4) the Board will grant Dr. Breuder an exception and name Dr. Breuder with “Emeritus” status upon his retirement; (5) Dr. Breuder will receive no compensation, insurance, or other benefits from the College after March 31, 2016 outside of this Fourth Addendum and the Benefits Summary; (6) Dr. Breuder agrees to assist the College in recruiting qualified permanent replacement candidates for the positions of Interim College President and College President for the College.
