BHEKI, THULANI FOUND GUILTY ACCORDING TO RUMOURS - LAWYER 07/05/2014 04:15:00BY MBONGISENI NDZIMANDZE Font size: Decrease font Enlarge font MBABABE - Lawyer Mandla Mkhwanazi has told the High Court that The Nation Magazine Editor Bheki Makhubu and Human Rights Lawyer Thulani Maseko have been found guilty, according to rumours. He alleged that the circulating rumours were also to the effect that a judgment in the matter had already been prepared. “There are rumours that a judgment has been prepared in this matter (contempt trial) and the accused (Makhubu and Maseko) have been found guilty,” said Mkhwanazi. Mkhwanazi who finished cross- examining State witness, Deputy Registrar of the Supreme Court Banele Ngcamphalala on Monday, yesterday applied that he be allowed to pose one more question. “Do you recall earlier on in your evidence in chief when you were being cross-examined by Advocate Lucas Maziya that you alluded to have heard circulating rumours regarding the issuance of the warrants or arrest against the accused,” asked Mkhwanazi. The defence counsel (Mkhwanazi) further put it to Ngcamphalala that she was on record telling the court that she heard a rumour that there were warrants of apprehension that were to be issued against the accused on May 17, 2014. In response, Ngcamphalala said she cannot recall since it has been a long time since the trial started. When it was again put to her by Mkhwanazi that she did say that, Ngcamphalala changed tune and told the court that she might have said that but she cannot recall. “Likewise, there are rumours that a judgment has been prepared in this matter (contempt trial) and the accused (Makhubu and Maseko) have been found guilty,” said Mkhwanazi. Judge Mpendulo wondered where such rumours came from and said he was not going to take them lightly as it bordered on his integrity. The judge also stated that he had not prepared any judgment. Mkhwanazi, however, said it was not for the court to say its perception but for the witness to answer. In response, Ngcamphalala told the court she was not aware of such rumours and she was hearing them for the first time. On Monday, Mkhwanazi informed the court that there were political connotations in the matter of Makhubu and Maseko.
