BREAKING NEWS: Allan Wadi, jailed university student to appeal his one-year jail sentence on three main grounds:- 1. Miscarriage of justice- The prosecution/the court never logged on to the contentious social networking account, and neither was the accused compelled to do the same, in order to authenticate its existence and/or its content and owner! Indeed, there was no reasonable attempt that was made to link the accused, to the said account, either by way of a last PC used, and maybe owned by the accused, or his cellphone! Excerpts/ printouts could be made anywhere on River Road, and by any computer literate pedestrian! 2. The accused was interrogated by cybercrime police, the kind that investigate online serial killers, fraudsters, economic conmen, etc, when in the actual sense, his was a mere misdemeanor that never required such intimidating covert tactics, which could have yielded extracted responses from the accused! 3. There was no complaint, either from the Kenyan government, or from any individual, before the accused was arrested and arraigned before the court! 4. The accused is a public university student, and like all public university students in Kenya, he is, at best, above the law! Kenyan university students are known to stone us, insult us, block our highways, but we accept and move on!
