If a child is in immediate danger, and a parent cannot intervene, then other family members should protect the child until the danger abates. Government should only get involved to the extent that a serious immediate danger can be abated, and then should have no jurisdiction once the specific danger is gone. Government is not a substitute or step-parent(s) to children. Even homeless children or children without living parents are taken care of by other family members as a moral right, and by community organizations (i.e. non profit child welfare organizations (NGOs), churches, pastors, Red Cross, Salvation Army, etc.). Children are not Government property or Government wards per se. It is becoming pandemic that aggressive CPS staff are far exceeding their jurisdiction and enabling statutes by taking children from parents for unspecified or uncharged reasons, without due process for the parents, and in may cases for arbitrary and capricious reasons. In one case, In Re Judy Irene Kuchta, a Child, Cause 10-120 in Kendall County, TX, the mother was asleep and an unrelated renter of a room spanked her 2 year old baby in front of witnesses. The assailant immediately fled to south TX and thus has no further access to the baby. A relative noticed bruises on the babys legs days later and took the baby to CPS, who, without interviewing anyone or getting court approval, seized the baby (March, 2010). Any person, or parent, in entitled to the lawful conduct of everyone around them, and cannot, as a matter of law, be negligent because their child was the victim of a crime. The Detective investigating is Clint Cook of the Boerne, TX police (830-249-8645). The mother has not had the baby since (8 months now) and she has been devastated and demoralized since, being subjected to oppressive requirements and intrusive fishing expedition exams since. The mother is Megan Medina Kuchta ((830) 392-6084) and natural father (in Baltimore on SSI is Joseph Kuchta, Jr. at (443) 299-3068). An intervention hearing is scheduled for December 2, 2010 at 10AM in Boerne, TX 78006 (201 E San Antonio), and the mothers final case hearing is January 26, 2011. The CPS worker involved has left CPS, but the unconstitutional / illegal seizure of the baby continues. I hope that someone can help this family and establish firm limits on CPS actions.
