Back in 1986 several interns, residents and a couple of professors were found selling Veterans body parts and fluids they had removed from Veterans in their care. The Veteran’s body parts and fluids were then sold on the black market for transplantation and to labs and colleges. At the time an investigation was started and it was never determined if any of the Veterans had signed a donations form giving their permission for the harvesting and sale of their body parts. Not only that, but the investigators DID NOT look into the possibility that the Veterans were killed by the VA medical staff for their body parts. The IG speculated that they had been paid hundreds of thousands of dollars for the Veterans body parts and bodily fluids they had sold on the black market. At the conclusion of the IG’s investigation the Interns, Residents and Professors involved were given a reprimand and fined $500.00 each. In 1996 a Veteran went to his local DVA Medical Center for treatment of a intestinal disorder. He was hospitalized and they preformed what was called exploratory surgery and released the next day. Over the following weeks he became very weak and was admitted to a civilian hospital. The civilian doctors said his kidney had failed and they had to remove one of his kidneys. When the civilian doctors opened him up they were shocked to find that he only had one kidney and it had been severely damaged by a botched attempt at removing it. When the Veteran submitted a claim with the VA’s adjudications officer his claim was denied. The reason given was the Veteran had not been admitted to the VA hospital. All of the Veterans medical records had been destroyed by the VA Medical personnel. I testified before the Congress that the death rate of the Department of Veterans Affairs was totally unacceptable. The DVA countered my charges by stating that because of the ages of the Veterans in their care that the death rate was comparable to those of other health care providers. That is until I provided the Congress with documents proving the average age of the Veteran dyeing within the Veterans health care system was between 35 and 40. Shortly after that the VA was elevated to a Cabnet position and all of the records were sealed to protect the Department against any future investigations. There have been far too many cover-ups the VA/Department of Veterans Affairs have been guilty of. It is far more important to protect the Department’s professors, interns and residents than is Veterans safety and health care. That is because whenever anything like this happens the Veteran and/or survivors must file a claim with the never ending adjudications system. That makes it easier for the Department to keep us and our spouses from receiving a just hearing before the Department’s Adjudications System. It also prevents us or keeps us from receiving quality health care from the DVA. Section 511 of Title 38 USC is protecting those who are guilty of these crimes against us as well as the Department as well. It is for this reason that we have got to push the Congress to repeal Section 511 and grant us our RIGJHT to Hometown health care AND to have our claims heard in a true Article III Federal Court. The time has come to GET ACTIVE while there is still time to act.
