Back in 2009, I argued in the Buffalo Intellectual Property Law Journal that the defense of laches should be unavailable within the three-year statute of limitations for copyright infringement claims. This morning the Supreme Court of the United States agreed with me by holding the same thing in Petrella v. Metro-Goldwyn-Mayer. (But I suspect there is something wrong with the courts Westlaw subscription because they forgot to cite my note!)
