Legal status: Mohammad Ibrahim Meah (BP-8706107787) Constable No.401 lodged first information report (FIR) against two persons namely 1) Sohag Gazi and 2) Sree Ashish Haldar at Motbaria P.S. case No. 35/254 dated 25..06.2014 against those victims under section 323/353/332/333/334/307 of Bangladesh Penal code. > Police arrested Sree Ashish Haldar (Hindu victim) on 24.06.2014 and physically assaulted him on both 24.06.2014 and 25.06.2014 and sent him to jail custody as he failed to pay a substantial amount of bribe (5 lacks of Taka ) to police; otherwise he would be tortured to death. > Sree Ashish Haldar, after release on bail, filed an appeal to Home Minister of Bangladesh, Secretary of Home Ministry, Chairman, National Human Rights Commission of Bangladesh, and Inspector-General of Police, Deputy Inspector General of Police, Barisal Range, Superintendent of Police, Perojpur and President of Bangladesh Minority Watch (BDMW) for redress. > Bangladesh Minority Watch engaged Lawyer for bail of the victim and A.K.M. Kamaluddin, Senior Judicial Magistrate -Perojpur granted bail of Ashish Haldar on 8th of July, 2014. Case in Brief: The name of minority Ticket Seller (Sree Ashish Haldar) while he (Sree Ashish Haldar) was on duty at his Patharghata Bus stand at Motbaria Upazila some police constables of Motbaria Circle namely 1) Mohammad Ibrahim, and one unknown person went to Patharghata Bus stand were sitting idle occupying chairs for an indefinite period; Sohag Gazi (28) another employee of said Bus stand requested those police constable to vacate the chair as other passengers were waiting for tickets. As a result Mohammad Ibrahim started to rebuke in filthy languages started fisting blows on Sohag Gazi. Sree Ashish Haldar wanted to stop such trampling. But angry police constable went to his office and came back again after 20 minutes with more police constables to arrest Mohammad Ibrahim, but Ibrahim was not at that time available at his Bus Stand. But police arrested Sree Ashish Haldar on the allegation of police assault, robbed his money bag containing Taka 48,000/-on way to Police office, pushed him a solitary room, brought him before Abdul Kalam Azad, Assistant Superintendent of Police, who started beating and directed his subordinate police constable to beat Ashish Haldar mercilessly with stick, due to abnormal beating and torture Ashish Haldar became senseless, vomiting started. As per statement made by Ashish Haldar, a criminal case has been started by Constable No.401 Mohammad Ibrahim with the direction of ASP (Circle) against him and other co-accused and remanded Ashish to jail custody with multiple injuries. Ashish took preliminary treatment at Perojpur Sadar Jail and got bail after 15 days on 9th of July, 2014 with the help of BANGLADESH MINORITY WATCH. Investigation: I, Adv. Rabindra Ghosh of BDMW communicated with Mr.Md.Shah Ameer- Superintendent of Police, Perojpur Additional Superintendent of Police, Perojpur Mr. Abdul Kalam Azad, ASP (Circle) Motbaria Mr. Nasiruddin Mullick Officer in Charge of Motbaria police station over their cell numbers (01713374330, 01713374330, 01713374334, 01713374342. I have also given them to understand that a serious written allegation of torture on Sree Ashish Halder has been received by Bangladesh Minority Watch filed by victim- Sree Ashish Haldar who is also undergoing treatment at Dhaka Hospital. All the police officers denied the allegation of torture by police. I have also met with him at Dhaka Medical College Hospital and came to know that the injuries (inflammable) are not visible but the internal injuries after such a long time is visible. I also reported this matter to Mr. Asaduzzaman- Home Minister of Bangladesh over his cell number who informed me to communicate with Mr.Khandakar – Inspector General of Police and I accordingly appraised this matter to IGP over his cell number and requested me to write a letter incorporating the nature of police assault and subsequent events. I also collected some disinterested witnesses such as 1) Ms. Jharna Rani Haldar, 2) Sawpan Haldar, at the Bus stand who elaborately informed me that the police without any lawful authority arrested Ashish Haldar and assaulted physically by ASP (Circle) due to religiously motivated on 25th night. Those witnesses also requested me not to disclose their identity because they apprehend further repression by the police. 5. Case Summary: Minority victim ( Sree Ashish Haldar) was physically tortured by ASP (Circle) and two other unknown constables at night on 25th June,2014 at about 9.15 p.m. at Motbaria Police station, Perojpur and police also robbed of Taka 48,000/- from the victim on way to police custody. False case has been started against victim for squeezing money and also for suppression of facts. 6. Recommendations: Bangladesh Minority Watch is very much shocked at the custodial torture and false allegation of police assault on Minority Victim-Sree Ashish Haldar: BDMW demand: a) Immediate arrest of perpetrators responsible for custodial torture on the victim. b) A Judicial Enquiry Team headed by a Sessions Judge from Judiciary should be appointed for independent and impartial enquiry/investigation. c) The injuries inflicted upon the victim due to custodial torture should be properly investigated and the perpetrators should be brought before the court for explanation. d) The compensation should be paid to the victim for treatment and also for his survival. e) The alleged case No.35/254 dated 25.06.2014 lodged by Police against the victim on the allegation of police assault at Bus stand should be investigated and dropped; if the case is found to be fabulous. f) The General Assembly resolution No.47/135 of 18th December, 1992 should be implemented/ adhered to as per UN Declaration. 7.
